Everything You Need to Know About Pakistan Real Estate

Trusted answers compiled by Mian Property Dealer's legal and property advisory team to help you navigate transactions with complete peace of mind.

Before committing funds to any residential or commercial project, always verify that the society has obtained a valid No Objection Certificate (NOC) and approved layout plan from the responsible civic body:

  • Lahore: Lahore Development Authority (LDA) approved societies portal.
  • Islamabad: Capital Development Authority (CDA) or Rawalpindi Development Authority (RDA).
  • Armed Forces Societies: Directorate of DHA (Defence Housing Authority) or Bahria Town head offices.

At Mian Property Dealer, every single listing undergoes rigorous title verification before being advertised to our clients.

A standard real estate transaction in Pakistan follows three structured phases:

  1. Token Money (Kacha Token): A nominal advance deposit (PKR 50,000 to 500,000) given by the buyer to hold the property while initial document verification takes place.
  2. Bayana (Pakka Token & Agreement to Sell): A formal legal contract signed on judicial stamp paper where the buyer pays 10% to 20% of the property value, with clear terms regarding remaining payment dates, possession, and utility clearances.
  3. Final Transfer & NDC: The seller obtains a No Demand Certificate (NDC) certifying all society dues and taxes are clear. Both parties appear in person (or via power of attorney) for biometric verification and transfer of ownership.

The Federal Board of Revenue (FBR) heavily incentivizes active tax filers. The primary taxes applicable during real estate transactions are:

Tax Provision FBR Active Filer Non-Filer / Late Filer
Advance Tax on Purchase (Section 236K) 3% Up to 10.5% - 15%
Advance Tax on Sale (Section 236C) 3% Up to 6% - 10%

Our advisors provide complete tax computation assistance to ensure smooth bank pay-order generation before transfer day.

Yes! A substantial portion of our clientele consists of overseas Pakistanis living in the UK, UAE, USA, Canada, and Europe.

You can appoint a trusted representative or our agency via a Special Power of Attorney (PoA). The PoA document must be signed and attested at the nearest Pakistani Embassy or High Commission, and subsequently counter-attested by the Ministry of Foreign Affairs (MOFA) in Pakistan. Funds can be securely transferred via State Bank of Pakistan's Roshan Digital Account (RDA).

To initiate transfer in private and armed forces housing societies, the seller must prepare:

  • Original Allotment / Transfer Letter
  • Clean No Demand Certificate (NDC) from society accounts
  • Valid Original CNIC and copies for buyer & seller
  • Passport-sized photographs with blue background
  • FBR Tax Challans (CPR) paid via authorized National Bank branches
